The conditions set out below govern access to and use of the website www.vibia.com and/or application (the “Website”). The owner of the Website is VIBIA LIGHTING, S.L.U., with registered office at C/ Progrés, 4-6, 08850 Gavà (Barcelona), with tax identification number (NIF) B-66241035, registered with the Commercial Registry of Barcelona under Volume 44,212, Folio 202, Sheet B-449,764, 1st entry (“Vibia”).
Access to and use of the Website grants the visitor to the Website the status of user (the “User”) and implies the User’s full acceptance of these conditions.
Vibia, as owner of the Website, informs the User that it complies with the obligations laid down in Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (“LSSICE”) and other applicable regulations.
Intellectual and Industrial Property of the Website
The Website and its contents, such as designs, texts, databases, graphics, logos, source code, illustrations, videos, photographs, industrial designs and any other signs capable of industrial and commercial use, are the exclusive property of Vibia or of third-party owners thereof who have duly authorised Vibia to include them on the Website.
The Website may include content generated or modified with artificial intelligence tools. In any event, Vibia documents the human creative contribution in the process of creating such content in order to preserve the intellectual property rights over it. AI-generated content that may be misleading as to its origin will be identified in accordance with the provisions of Article 50 of Regulation (EU) 2024/1689 (“AI Act”).
Vibia does not grant the User any licence or authorisation over Vibia’s industrial and intellectual property rights or over any other right related to the Website and the services offered on it. Likewise, the User does not acquire, by virtue of the contracted service, any right or licence over the software necessary for the provision of the service, nor over the technical service-monitoring information, except for the rights and licences necessary to perform the contracted services and only for the duration thereof.
The extraction and use of the content of the Website is not permitted without the express written consent of Vibia, regardless of the means of extraction.
The User acknowledges and accepts that the reproduction, distribution, marketing, transformation and, in general, any other form of exploitation of all or part of the contents of the Website constitutes an infringement of the intellectual and industrial property rights of Vibia or, where applicable, of the owner thereof.
Links to third-party websites
This document refers solely to the Website and does not apply to any third-party links or websites that may be accessible through the Website.
The introduction of hyperlinks for commercial purposes on third-party websites that allow access to the Website without the prior express consent of Vibia is expressly prohibited. Under no circumstances shall the existence of hyperlinks on sites outside the Website imply the existence of commercial or business relationships with the owner of the website where the hyperlink is established, nor Vibia’s acceptance of its contents or services.
In any event, Vibia is not liable for the use or content of third-party websites that may link to the Website.
Users’ obligations and responsibilities
By way of example and without limitation, the User undertakes to:
The User bears full responsibility for the content of its website, the information transmitted and stored, the hypertext links, third-party claims and legal actions relating to intellectual property, third-party rights and the protection of minors.
The User is responsible for compliance with the laws and regulations in force and the rules relating to the operation of the online service, electronic commerce, copyright, the maintenance of public order, as well as the universal principles governing the use of the Internet.
Therefore, the User is solely responsible for any damage it may cause and for any infringements it may incur through the use of the Website, and Vibia and the companies of its group are released from any kind of liability that may arise from the User’s conduct and actions. The User shall indemnify Vibia for any costs that may arise from Vibia being named in any proceedings for which liability is attributable to the User, including legal fees and defence costs, even in the case of a non-final court decision.
Protection of hosted information
Vibia makes backup copies of the content hosted on its servers; however, it is not liable for the loss or accidental deletion of data by the User. Likewise, it does not guarantee the full restoration of data deleted by the User, since such data may have been deleted and/or modified during the period of time elapsed since the last backup.
The services offered, except for specific backup services, do not include the restoration of content kept in the backups made by Vibia where such loss is attributable to the User; in this case, a fee will be determined according to the complexity and volume of the recovery, always subject to the User’s prior acceptance.
The restoration of deleted data is only included in the price of the service where the loss of content is due to causes attributable to Vibia.
Liability and warranties
Due to the open nature of the Website, we cannot guarantee the reliability, usefulness and accuracy of all the information on the Website. Vibia will use all reasonable efforts and means to keep the Website updated at all times. Vibia implements, at all times, the appropriate security measures in order to present Users with adequate, accurate and up-to-date information and services, and reserves the right to correct those aspects that may occasionally and fortuitously be affected by inaccuracies, outdated information or errors.
Access to the Website does not entail any obligation on Vibia to monitor the absence of viruses, worms or any other type of harmful software. It is the User’s responsibility to have sufficient tools to detect and prevent infections by such programs. Vibia is not liable for any damage caused to the User’s computer equipment and installations while accessing the Website.
The contents and information do not bind Vibia nor do they constitute opinions, advice or legal advice of any kind, as this is merely a service offered for informational and educational purposes.
Vibia complies with the obligations arising from the AI Act.
Amendments
Vibia reserves the right to modify or update the information contained on the Website or its terms of use and access at any time and without prior notice.

Governing law and jurisdiction
This legal notice shall be governed by and construed in accordance with Spanish law, and any disputes arising from it shall be settled before the Courts and Tribunals of the city of Barcelona, which shall have exclusive jurisdiction to the exclusion of any other venue.
